Resolution No. 4563 Meadowview
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE OAKLAWN IMPROVEMENT DISTRICT PERTAINING TO THE ABATING OF A NUISANCE ON PROPERTY LOCATED WITHIN THE OAKLAWN IMPROVEMENT DISTRICT.
WHEREAS, it was determined on the 19th. day March, 2014, that a nuisance in violation of Resolution No. 10-20-04(a) existed on property located within Oaklawn at 4563 Meadowview that is legally described as follows:
Lot 15, Block 26, Oaklawn Sub, Sedgwick County, Kansas (the Property); and
WHEREAS, ATJ Management LLC (the Owner of Record) was served notice on the 20th. day of March, 2014, to abate the nuisance on the Property by the 31st. day of March, 2014.
WHEREAS, the Owner of Record failed to abate the nuisance by the 31st. day of March, 2014, which still existed on the Property as of the date of the adoption of this Resolution; and
WHEREAS, the Owner of Record failed to request a hearing before the Board of
Directors of the Oaklawn Improvement District within the time limit set in the notice which the Owner of Record received that is referred to above.
NOW, THEREFORE, be it resolved by the Board of Directors of the Oaklawn Improvement District as follows:
1. Abatement. Based upon the above findings it is ordered that the Oaklawn Improvement District’s Public Officer proceed to abate the nuisance that exists on the Property.
2. Assessment of Costs. The costs of abating the nuisance on the Property when the abatement is completed shall be billed to the Owner of Record. If the Owner of Record does not pay the bill within thirty (30) days then the costs of abatement or any unpaid portion not paid by the Owner of Record shall be certified by the Clerk of the Oaklawn Improvement District to the County Clerk of Sedgwick County, Kansas in order that the County Clerk can place on the tax rolls to be collected by the County Treasurer and paid to the Oaklawn Improvement District.
ADOPTED AND APPROVED by the Board of Directors of the Oaklawn Improvement District on this 2nd. day of April, 2014.
